1. PRIVACY POLICY AND DATA MANAGEMENT
Collection and Use: We collect personal information voluntarily provided (name, email, project-related business info) via contact forms, emails, phone calls, WhatsApp, or consultation requests. This data is used exclusively to respond to budget inquiries, deliver web design/consulting services, maintain active project communication, and enhance client experience.
Sharing and Security: EMLEK Digital Choices does not sell, rent, or trade your data. We share limited information only with essential technical service providers (hosting, payment processors). We employ reasonable security measures, but due to the inherent nature of the internet, 100% absolute security cannot be guaranteed.
Cookies and Analytics: The website may use basic cookies and technical analytics tools to improve site performance, security, and user experience. You have the right to disable or delete cookies at any time through your web browser configuration settings.
2. TERMS OF SERVICE AND PROJECT CONDITIONS
Services Provided: We offer professional services in website design, development, technical maintenance, landing pages, business websites, branding, digital identity, and technical support.
Agreements and Payments: Each project is governed by a written proposal or estimate detailing the scope, deliverables, and timeline. Unless agreed otherwise in writing, a 50% initial deposit is required before starting work, and the remaining 50% balance must be fully paid prior to final deployment or website publication.
Client Responsibilities: The client agrees to provide accurate business information, logos, images, and text content required for development, guaranteeing full intellectual property rights over such assets and holding EMLEK Digital Choices harmless from any third-party copyright claims.
Third-Party Providers and Disclaimers: We may utilize third-party services (hosting, domains, payment gateways). We are not responsible for failures, outages, or service disruptions beyond our control. Services are delivered under professional standards, but we do not guarantee specific financial outcomes, sales increases, or search engine rankings.
3. INTELLECTUAL PROPERTY AND SPECIAL CLAUSES
Rights Retention and Transfer: All design concepts, sketches, logos, source code, and structures developed remain the exclusive intellectual property of EMLEK Digital Choices until the invoiced balance is 100% settled. Upon full payment, commercial use, reproduction, and modification rights for the final approved design, branding, and custom code are automatically transferred to the client.
License Exclusions: This transfer does not include software licenses, CMS platforms (WordPress, Shopify, etc.), third-party themes or plugins, or copyrighted stock media/fonts. The client remains responsible for maintaining their own active software subscriptions and licenses.
Authorship Credit and Portfolio: We reserve the perpetual, royalty-free, and irrevocable right to display screenshots, links, and final logos in our digital portfolio, website, and social media for promotional purposes, unless a non-disclosure agreement (NDA) specifying otherwise has been previously signed by both parties..
Color Variation: The client acknowledges that minor tone, brightness, or cutting margin variations may occur between the digital design (RGB) and the final physical printed product (CMYK/Pantone) due to printing machinery calibrations. These variations do not constitute a defect or grant refund rights.
4. GOVERNING LAW AND LOCAL JURISDICTION
This agreement shall be governed by and construed in accordance with the laws of the State of Florida, USA. Any dispute, claim, or legal action arising from our services shall be resolved exclusively in the courts of Pasco County, Florida, USA.
